Welcome to KitchenMate AI ("Service"), operated by Vyzent Solutions ("Company," "we," "us," or "our"). By downloading, installing, accessing, or using our mobile application or website, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use our Service. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of the modified Terms.

2. Description of Service

KitchenMate AI is an artificial intelligence-powered mobile application that:

  • Analyzes food photographs to identify ingredients and dishes
  • Generates personalized recipes based on your preferences
  • Provides recipes in multiple languages (11+ supported)
  • Allows users to save, organize, and share recipes
  • Offers customization options for cuisine type, dietary restrictions, spice level, and serving size

3. User Accounts

3.1 Account Creation

To access certain features of the Service, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Age Requirement

You must be at least 13 years of age to use this Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. Subscription and Payments

4.1 Free Tier

The Service offers a free tier that includes:

  • 10 free recipe generations
  • Ability to earn bonus recipes by watching advertisements
  • Access to save and share recipes
  • All supported languages

4.2 Premium Subscription

Premium subscription features include:

  • Unlimited recipe generations
  • Ad-free experience
  • Priority support
  • Cross-device synchronization

4.3 Billing

Premium subscriptions are billed on a recurring monthly basis. Payment will be charged to your Apple App Store or Google Play Store account upon confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of the current billing period. We do not provide refunds for partial billing periods. For refund requests, please contact your respective app store.

5. User Content

5.1 Your Content

You retain ownership of any content you submit to the Service, including photographs and preferences. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and analyze such content solely for the purpose of providing and improving the Service.

5.2 Content Guidelines

You agree not to upload or share content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Infringes on intellectual property rights of others
  • Contains malware, viruses, or harmful code
  • Is not food-related or intended to misuse the AI system

6. AI-Generated Content Disclaimer

6.1 Nature of AI Recipes

Recipes generated by KitchenMate AI are created using artificial intelligence and are provided for informational and entertainment purposes. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or unexpected combinations.

6.2 Food Safety

Important: You are solely responsible for ensuring food safety when preparing any recipe. Always:

  • Verify cooking temperatures and times from authoritative sources
  • Check for allergens and dietary restrictions
  • Use proper food handling and storage practices
  • Exercise your own judgment regarding ingredient combinations

6.3 Allergies and Dietary Restrictions

While we provide dietary preference options, we cannot guarantee that AI-generated recipes will be completely free of allergens or suitable for specific medical dietary requirements. Always verify ingredients if you have allergies or health conditions.

7. Intellectual Property

7.1 Our Property

The Service, including its design, features, functionality, and content (excluding user content), is owned by Vyzent and protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

8. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Use automated systems or bots to access the Service
  • Interfere with or disrupt the Service or servers
  • Collect user information without consent
  • Resell or redistribute the Service without authorization
  • Use the Service to generate content for competing products

9. Third-Party Services

The Service may integrate with or contain links to third-party services, including but not limited to:

  • Authentication providers (Google, Apple Sign-In)
  • Payment processors (via app stores)
  • Analytics services
  • Advertising networks

Your use of third-party services is subject to their respective terms and privacy policies.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Results obtained from the Service will be accurate or reliable
  • Any errors in the Service will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VYZENT SOLUTIONS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or use
  • Personal injury or property damage
  • Any damages arising from food preparation based on AI-generated recipes
  • Any matters beyond our reasonable control

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Vyzent Solutions and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable Indian arbitration laws, unless you opt out within 30 days of first using the Service.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the app or via email. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vyzent Solutions regarding the Service and supersede all prior agreements and understandings.
